MANTUA VILLAGE
Regular Council Meeting
June 21, 2005

Mayor Hopkins opened the meeting at 7:00p.m., at Village Hall, and led the Pledge of Allegiance. He also asked for a moment of silence for John Wheeler, who passed away recently.

ROLL CALL: M. Hura, J. Rogers, P. Campbell, P. Janson, and L. Schilling. W. Hawkins was not present.

OTHERS PRESENT: Clerk-Treasurer Betsy Woolf, Assistant Clerk Mary Pallone, Police Chief Buchert, Village Solicitor David Benjamin, Village Administrator Ed Trego, Village Engineer Rich Iafelice, and several village and township residents.

MAYOR’S REPORT: Mayor Hopkins thanked Don and Linda Schilling for plantings at the mini park and also to the press coverage of the Soap Box Derby. He thanked the Chamber of Commerce for donating flower baskets on Main Street. Mr. Hopkins also thanked the service department for taking on the watering and care of the baskets. The gas station property has been signed off. Proposed budgets were submitted by Chief Buchert and Village Administrator Trego.

APPROVAL OF MINUTES of May 17th, 2005. L. Schilling made a motion to bring to the floor and a second was made by P. Campbell. All ayes on roll call. Motion to approve as submitted was made by L. Schilling and seconded by J. Rogers. All ayes on roll call.

CLERK’S REPORT: B. Woolf submitted the May financials and stated they are in the clerk’s office for viewing.

BILLS OF RESOLUTION AND ADDENDUM: A motion to bring to the floor was made by L. Schilling and seconded by P. Campbell. All ayes on roll call. A motion to approve as submitted was made by M. Hura and seconded by J. Rogers. All ayes on roll call.

LEGISLATION:
ORDINANCE 2005-10 AN ORDINANCE ACCEPTING THE DEDICATION OF THE WATER/SANITARY SEWER HARDWARE OFFERED BY THE CRESTWOOD LOCAL SCHOOL BOARD OF EDUCATION AS A PART OF THE VILLAGE OF MANTUA WATER/SANITARY SEWER SYSTEM, AND DECLARING AN EMERGENCY. Presently tabled. The Mayor asked for a motion to move the ordinance off the table. No response was made to do so. Remains tabled.

ORDINANCE 2005-11 AN ORDINANCE APPROVING THE RECODIFICATION, EDITING AND INLCUSION OF CERTAIN ORDINANCES AS PARTS OF THE VARIOUS COMPONET CODES OF THE CODIFIED ORDINANCES OF MANTUA, AND DELCARING AN EMERGENCY. 3rd Reading. A motion to bring to the floor was made by J. Rogers and seconded by P. Campbell. All ayes on roll call. Motion to pass made on 2nd reading by J. Rogers and second by L. Schilling. All ayes on roll call.

ORDINANCE 2005-13 AN ORDINANCE AMENDING PRIOR ORDINANCE NOS. 1972-2, 1983-08, 1984-46, 1989-17, and 1994-04, 2003-36, 2004-18 AND CHAPTER 921 OF THE MANTUA CODE OF ORDINANCES CONCERNING WATER SERVICES PROVIDED BY THE VILLAGE OF MANTUA, AND DECLARING AN EMERGENCY. 3rd Reading. Mayor Hopkins suggested Ordinance 2005-13 be tabled. J. Rogers made a motion to table legislation and it was seconded by P. Campbell. All ayes on roll call.

ORDINANCE 2005-14 AN ORDINANCE AMENDING PRIOR ORDINANCE NOS. 1996-23, 1997-5, AND 1982-23, 2003-37, 2004-19 AND CHAPTER 931 OF THE MANTUA CODE OF ORDINANCES, CHAPTER 931 CONCERNING SEWER SERVICES PROVIDED BY THE VILLAGE OF MANTUA, AND DECLARING AN EMERGENCY. 3rd Reading. Mayor Hopkins suggested Ordinance 2005-14 be tabled. J. Rogers made a motion to table legislation and it was seconded by L Schilling. All ayes on roll call.

ORDINANCE 2005-16 AN ORDINANCE APPROVING A CONSULTING AGREEMENT WITH THE PORTAGE REGIONAL PLANNING COMMISSION TO ASSIST THE VILLAGE IN COMPILING A COMPREHENSIVE GROWTH PLAN, AS RECOMMEDED BY THE VILLAGE PLANNING COMMISSION, IN AN AMOUNT DECREASED BY THE ANNUAL CREDITS TO WHICH THE VILLAGE IS ENTITLED FOR ITS ANNUAL PAYMENT DUES, AUTHORIZING THE MAYOR AND THE CLERK-TREASURER TO ENTER INTO AN AGREEMENT TO THIS EFFECT, AND DECLARING AN EMERGENCY. 2nd Reading. M. Hura made a motion to bring to the floor and it was seconded by J. Rogers. All ayes on roll call. A motion to approve on 2nd reading was made by M. Hura and seconded by J. Rogers. All ayes on roll call.

ORDINANCE 2005-17 AN ORDINANCE APPROVING THE ACQUISISITION OF A POLICE CRUISER FROM A DESIGNATED STATE-BID PURCHASING PROGRAM, AUTHORIZING THE MAYOR, THE VILLAGE CLERK-TREASURER AND THE VILLAGE POLICE CHIEF TO ENTER INTO AN AGREEMENT TO THIS EFFECT, FURTHER AUTHORIZING THE VILLAGE CLERK-TREASURER TO ACQUIRE THE FUNDS NECESSARY TO COMPLETE THIS PURCHASE, AND DECLARING AN EMERGENCY. 2nd Reading. A motion to bring to the floor was made by L. Schilling and seconded by P. Janson. All ayes on roll call. A motion to approve on 2nd reading was made by. Schilling and seconded by P. Janson. All ayes on roll call.

ORDINANCE 2005-18 AN ORDINANCE APPROVING AND ADOPTING A PERMANENT BUDGET FOR 2006 FOR THE VILLAGE OF MANTUA, AND DECLARING AN EMERENCY. 1st Reading. A motion to bring to the floor was made by M. Hura and seconded by L. Schilling. All ayes on roll call. P. Campbell asked what was meant by ‘permanent’ and the clerk responded that it for one year. Mayor Hopkins added that this is a ‘wish list’ for the Village. M. Hura made a motion to approve on 1st reading and it was seconded by P. Janson. All ayes on roll call.

M. Hura made a motion to accept all committee reports. L. Schilling seconded the motion. All ayes on roll call. The reports will be on file in the clerk’s office.

R. Iafelice with CT Consultants had nothing to report.

E. Trego, Village Administrator, told Pearl Campbell that the department is still looking at backflow prevention and practices for the Village.

Police Chief Buchert had nothing to report.

Assistant M. Pallone had nothing to report.

There were no further comments from Council, the Solicitor, Clerk or Mayor.

The public comments were from Les Hopkins who wanted to know what giving up points was costing the Village and what will we receive, referring to Ordinance 2005-16. Councilman J. Rogers stated that the Village has a plan with the Portage County Regional

Planning Commission and that they are going to have focus groups to discuss managed growth for the Village. He also stated that the extra cost over the next 2 years is an additional $37,000.00 to the Village.

Ben Prescott was recognized and had no comment. Vickie ? is interested in opening a business in Mantua. Linda Clark asked about permits at the new Village Hall. The Mayor answered that according to the zoning inspector, the Village doesn’t need a permit to renovate the interior of the building. The Clerk said she would talk with Ted Manfrass about permits. Mrs. Clark also asked about the Lions Club and the concession stand in the park; wanting to know if they paid their share of the water, electric and sewer. Mayor Hopkins stated that the club donates at the end of each year approximately $400.00 for use of the building. John Clark had no comments.

J. Rogers made a motion to adjourn and the motion was seconded by P. Campbell. All ayes on roll call. The June council meeting adjourned at 7:20pm.
